Caspio Acceptable Use Policy

INTRODUCTION
As a provider of application and database services, Caspio offers its subscribers and their customers and users functional access to electronic data, files and information. While Caspio respects free and open dissemination of information, when there are competing interests at issue, Caspio reserves the right to take preventative or corrective action within the framework of Caspio’s Services. As a result, Caspio has developed this Acceptable Use Policy (“AUP”) as a guide to the customer’s rights and obligations when utilizing Caspio’s services.

This AUP may be revised from time to time, and it shall be incumbent upon customers to continually review and comply with the latest version. Changes to the AUP will be timely posted on Caspio’s web site, caspio.com.

POLICY
As a Caspio customer or representative thereof, you may not use, or allow access to, Caspio services to:

1. Spam or send unsolicited commercial messages.
2. Disrupt the performance of Caspio servers or cause server-wide outages.
3. Advertise, transmit, store, post, display, or otherwise make available materials that:
   • Violate any law, regulation, or other provisions having the force of law, whether intentionally or unintentionally;
   • Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity;
   • Infringe or misappropriate the intellectual property rights of others;
   • Violate privacy, publicity, or other personal rights of others;
   • Falsify the origin of an email by forging the sender address or email header;
   • Are of adult nature, pornographic, or harmful to minors;
   • Exploit the images of children or disclose personally identifiable information of children;
   • Are unlawful, harmful, vulgar, obscene, threatening, abusive, harassing, tortuous, unlawful or libelous;
   • Are viruses, worms, Trojan horses, or other destructive codes, files, or programs, or information regarding the creation of such material.

If Caspio in its sole discretion determines that you have violated the terms of this AUP, such shall be grounds for immediate termination of your Caspio account without notice to you or penalty to Caspio.
